Milli Terms of Use

Welcome to Milli. These Terms of Use (“Terms”) govern your use of our services, including the Milli mobile application and Milli web portal (collectively, “Milli”), developed by Genvis Pty Ltd. For Genvis Terms of Use, please visit here.

Please read these Terms carefully as they contain important information about your rights and responsibilities, subscription and payment terms, your content, privacy, limitations of liability, and other key matters.

Milli is operated by Genvis in partnership with Todaybreak, a not-for-profit program owner focused on technology-driven social impact.

By accessing or using Milli, you agree to be bound by these Terms and our Privacy Policy. References to “Genvis,” “Milli,” “Us,” “We,” and “Our” refer to Genvis Pty Ltd, an Australian company.

1. Eligibility

1.1 Binding Contract

You may use Milli only if you are legally able to enter into a binding contract and comply with all applicable laws.

1.2 Age Requirement

You must be at least 13 years old to use Milli. If you are under 13, you may use Milli only under the direct supervision of a parent, guardian, or other authorised adult (e.g. teacher) who agrees to these Terms.

1.3 Compliance with Laws

You agree to comply with all applicable local, state, national, and international laws in connection with your use of Milli.

2. Data Handling & Cross-Border Privacy

2.1 Data Collection and Use

We collect and use your data in compliance with applicable privacy laws, including the Australian Privacy Act 1988, the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada, and the General Data Protection Regulation (GDPR), where applicable.

We process personal data based on your consent, our legitimate interests, or to fulfil our contractual obligations.

2.2 Data Origin and Hosting

Data is generated in your country of residence and securely transmitted to servers located in Canada. By using Milli, you acknowledge your data will be stored and processed in Canada under Canadian privacy laws.

2.3 Access by Support Staff

Authorised Genvis team members in Australia and Canada may access the minimum necessary data to provide customer support or technical assistance. All access is role-based and logged.

2.4 Your Rights

You may request access, correction, or deletion of your personal data, or object to its processing by contacting privacy@genvis.co.

2.5 Data Transfers

We apply appropriate safeguards to any international transfers of personal information, including adherence to relevant data protection frameworks.

2.6 Data Retention

We retain personal information only for as long as necessary to provide Milli services, meet legal obligations, resolve disputes, and enforce our agreements. When your data is no longer required for these purposes, we take steps to securely delete or anonymise it.

If you delete your account, your personal information will be removed from active systems within 30 days, except where retention is required by law or permitted for legitimate business or legal purposes (e.g. fraud prevention, compliance, or dispute resolution).

We may retain anonymised and aggregated analytics or insights data indefinitely for the purposes of improving the service, conducting research, or supporting program evaluation. This data does not identify you and is not linked to your personal information.

Please note that deleted data may continue to exist in encrypted backup archives for a limited time as part of our disaster recovery and business continuity procedures. Such backups are subject to automatic deletion in accordance with our backup cycle and are not restored or accessed except in the event of system failure or data loss.

3. Cookies and Tracking Technologies

Milli uses Google Analytics and similar technologies to improve performance and support development. These may collect data such as device type, usage patterns, and feature interactions. You can manage or limit tracking through your device or browser settings. Some features may not work as well if you do. See our Privacy Policy for more information.

4. Accessibility

WCAG 2.1 AA Commitment

Milli aims to meet the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA to ensure accessibility for users with disabilities. This includes:

  • Readable text for users with cognitive differences

  • Keyboard-only navigation support

  • Sufficient contrast for low vision

  • Alt text for images

  • Compatibility with assistive technologies

5. Your Content & Permissions

You retain ownership of any content you upload (“Your Content”). By using Milli, you grant Genvis a licence to store, process, and share Your Content as necessary to operate and improve the service.

We may share data with trusted third parties solely for service delivery. You confirm you have the legal rights to upload and share any content you submit. We will never sell or monetise your content or data without your explicit consent.

6. Your Responsibilities

6.1 Security

Keep your login details confidential and use a secure password. Do not share access.

6.2 Intellectual Property

Only upload or share content you have the legal right to use. Respect others’ intellectual property.

6.3 Prohibited Conduct

You must not use Milli in any way that is unlawful, harmful, or interferes with the experience or rights of others. Specifically, you must not:

  • Access, use, or attempt to access another user’s account without their express permission.

  • Impersonate any person or organisation, misrepresent your identity, or falsely claim affiliation with any entity.

  • Tamper with, disable, or otherwise interfere with security features, authentication systems, or protective mechanisms within Milli.

  • Attempt to reverse engineer, decompile, disassemble, or otherwise derive source code or technical functionality from any part of the platform.

  • Upload, publish, or distribute content that is false, misleading, defamatory, abusive, obscene, threatening, invasive of privacy, or otherwise unlawful.

  • Introduce malicious software, viruses, or automated tools that may damage, disrupt, or compromise Milli or its users.

  • Circumvent technical or administrative restrictions designed to protect system integrity or limit feature access.

Any breach of this section may result in suspension or termination of your account, legal action, and/or referral to relevant authorities. We ask you to help keep Milli safe for everyone.

7. Software and Features

7.1 Access and Licence

You are granted a limited, revocable, non-transferable licence to use Milli, subject to these Terms.

7.2 Beta Services

From time to time, we may offer access to Beta features that are still in development. These features are provided for evaluation purposes only and may not function reliably or as intended. By choosing to use Beta features, you acknowledge that they may be unstable, subject to change, or withdrawn without notice. Your use of Beta features helps us gather feedback to assess their viability and ensure that any public release meets functional, security, and usability requirements.

7.3 Language Availability

Milli is available in multiple languages through automated translation services to support users from diverse backgrounds. These translations are provided for convenience only and may not be fully accurate. Genvis is not responsible for the quality, accuracy, or completeness of translated content. Where clarity is essential, users should refer to the English version of the app.

8. Connecting to Cudo

You may choose to connect your Milli account with organisations that use Genvis’ Cudo platform— a public safety system used by government agencies and nonprofit service providers to support individual and community safety. You retain full control over what information is shared through this connection. You can manage or revoke access at any time via your app settings.

9. Third-Party Features

If you use third-party features (e.g. SMS), Genvis is not responsible for their performance. Where features like Check In or Request Help from your Trusted Contacts use SMS, messages are sent via your mobile plan. You are responsible for any resulting charges.

10. Security

Genvis is a trusted technology partner to government agencies and non-profit organisations working in the public safety, emergency management, and community support sectors. We understand the critical importance of safeguarding sensitive information and are committed to maintaining secure, reliable systems. We implement industry best practices, including data encryption, role-based access controls, system monitoring, and secure infrastructure hosted in Canada. Our security protocols are regularly reviewed and enhanced to keep pace with evolving standards.

However, no digital system is entirely immune to risks. While we take reasonable steps to protect your information, we cannot guarantee absolute protection against unauthorised access, cyber threats, or data loss. By using Milli, you acknowledge these risks and agree to take appropriate precautions, such as securing your device and protecting your account credentials.

11. Billing & Subscription Management

Milli is free to use, with optional Paid Plans available for extra features and storage. Subscriptions are managed via your app store account.

  • Charges are in your local currency and include applicable taxes

  • Subscriptions auto-renew unless cancelled before the billing cycle ends

  • You are responsible for managing your own subscription, payment methods, and cancellations

  • Pricing changes will be communicated in advance where possible

  • Refunds are not issued except where required by law. In exceptional circumstances, we may issue partial refunds at our discretion. If you purchased your subscription via the Apple App Store or Google Play, any refund requests must be submitted directly through those platforms in accordance with their policies.

12. Termination

We may suspend or terminate your account if:

  • You breach these Terms

  • Your use poses a risk to others or the platform

  • You are inactive for more than 12 months and not on a Paid Plan

Where feasible, we will notify you at least 30 days in advance and offer the opportunity to log in or export your content. Terminated accounts may lose access to stored data.

13. Intellectual Property

Milli and all related intellectual property — including its software, source code, design, branding, user interface, documentation, and any associated content or materials — are and remain the exclusive property of Genvis Pty Ltd and its licensors.

You may not copy, reproduce, modify, republish, transmit, distribute, reverse engineer, decompile, create derivative works from, or otherwise exploit any part of Milli or its components without prior written consent from Genvis.

Use of Milli does not grant you any ownership rights or licences except as explicitly provided in these Terms. All rights not expressly granted are reserved.

Any unauthorised use may result in immediate termination of your account and may be subject to legal action.

13.1 Analytical Data

We collect anonymised, aggregated data (“Analytical Data”) to improve Milli and support research. This data remains the property of Genvis and may be shared with Todaybreak or approved partners for non-commercial research or program evaluation.

Under no circumstances is your personal or identifiable information shared without your explicit consent.

13.2 Feedback

By submitting feedback, suggestions, or ideas, you grant Genvis full rights to use them. We are not obliged to provide credit or compensation.

14. Indemnification

You agree to indemnify Genvis from any claim arising from:

  • Your Content infringing on third-party rights

  • Your breach of these Terms

  • Misuse of the service by you or someone using your account

To the extent permitted by law, Genvis is not liable for:

  • Indirect or consequential loss

  • Data loss or unauthorised access

  • User-generated content

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under applicable consumer law, including the Australian Consumer Law.

15. Discontinuation of Services

In rare cases (e.g. legal changes, disasters), we may discontinue Milli. Where possible, we will provide 30 days’ notice and refund any unused prepaid fees.

16. Updates to Terms

We may update these Terms by providing at least 30 days’ notice via email or in-app notification. If you do not agree, you must cancel your account before the new Terms take effect. Continued use of Milli constitutes acceptance of the updated Terms.

17. Services “As Is”

We are committed to delivering a reliable and useful service and take reasonable steps to ensure Milli operates effectively and securely. However, Milli is provided “as is” and “as available,” and we do not guarantee that access will be uninterrupted, error-free, or suitable for every purpose.

Nothing in these Terms excludes, restricts, or modifies any rights you may have under applicable consumer protection laws, including the Australian Consumer Law and, where applicable, Canadian provincial and federal consumer legislation.

To the extent permitted by law, our liability is limited to the re-supply of the services.

18. Dispute Resolution

These Terms are governed by the laws of Western Australia, except where otherwise required by local law.

If you reside in Canada, these Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

In all cases, you agree to first attempt to resolve any dispute by contacting us at support@genvis.co.

All claims must be brought within one year of the incident and resolved individually—class actions are not permitted, except where prohibited by law.

19. Additional Terms

If any part of these Terms is held invalid, the rest remains effective. Genvis may assign these Terms to an affiliate or successor with notice. Translations are for convenience only; the English version prevails unless otherwise required by law.

21. Definitions

Account: The registered profile you create to access Milli.

Analytical Data: Anonymised and aggregated usage data collected for development and research.

App Store: Apple App Store or Google Play Store where the Milli app is distributed.

Beta Services: Features released for early access and feedback, not yet final.

Cudo: A Genvis platform that may be optionally linked to your Milli account.

Content: Any text, images, or files you upload to Milli.

Feedback: Suggestions, input, or ideas you share with us.

Genvis: Genvis Pty Ltd, the Australian company operating Milli.

Milli: The software application (mobile and web) governed by these Terms.

Paid Plan: A subscription-based version of Milli offering premium features.

Personal Information: Data about an identifiable individual as defined by law.

Privacy Policy: Our policy outlining how we collect, use, and protect your data.

Support Services: Technical help or customer assistance provided by Genvis.

Todaybreak: A not-for-profit partner organisation working with Genvis to deliver technology for social good.

User: Any individual or organisation accessing Milli.
